Terms of Service

1. Acceptance of Terms

By accessing or using mentova ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including free and paid accounts.

2. Description of Service

mentova is a software-as-a-service platform that measures brand visibility in AI-generated responses. The Service sends prompts to third-party AI models (OpenAI, Anthropic, Google, Perplexity), analyzes their outputs for brand mentions, and provides analytics dashboards and reports.

3. Account Registration

  • You must provide accurate and complete registration information.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 18 years old or the age of majority in your jurisdiction.
  • One person or entity may not maintain more than one free account.

5. Subscription & Billing

  • Paid plans are billed monthly or annually in advance via Stripe.
  • You may upgrade, downgrade, or cancel your subscription at any time from your account settings.
  • Downgrades take effect at the end of your current billing period.
  • Refunds are available within 14 days of initial purchase for annual plans. Monthly plans are non-refundable.
  • We reserve the right to change pricing with 30 days' notice. Price changes do not affect active billing periods.

6. Data & Intellectual Property

  • You retain ownership of all data you provide to the Service (brand names, topics, etc.).
  • We retain ownership of the Service, its software, analytics algorithms, and all derived insights generated by the platform.
  • AI-generated responses analyzed by the Service are owned by their respective AI providers. We do not claim ownership of third-party AI outputs.
  • Aggregated, anonymized usage data may be used to improve the Service.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or to violate any laws.
  • Attempt to gain unauthorized access to the Service or its infrastructure.
  • Use the Service to monitor brands you do not have a legitimate business interest in.
  • Resell, redistribute, or sublicense access to the Service without written consent.
  • Interfere with or disrupt the Service, servers, or networks.
  • Circumvent usage limits, rate limits, or other technical restrictions.

7. Service Availability

We strive for high availability but do not guarantee uninterrupted service. The Service depends on third-party AI providers whose availability is outside our control. Scheduled maintenance windows will be communicated in advance when possible.

8. Limitation of Liability

To the maximum extent permitted by law, mentova shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your account if you violate these terms or engage in abusive behavior. Upon termination, your right to use the Service ceases immediately. You may request export of your data within 30 days of termination.

10. Governing Law

These terms are governed by the laws of Belgium. Any disputes shall be resolved in the courts of Brussels, Belgium.

11. Changes to Terms

We may modify these terms at any time. Material changes will be communicated via email or in-app notice at least 30 days before taking effect. Continued use of the Service constitutes acceptance of updated terms.
